1st of all, I am a vet, a retired USN officer (Surface Warfare not JAG) and a Chief Engineer on 3 Navy ships. I am now an atty and have a case befopre the US Court of Appeals for Vets Claims on Navy Agent Orange. First issue if your ship was within the inland waters including harbors or terriortial waters you were considered to be in Vietnam. 66 Fed. Reg. 2366 (May 8, 2001). Secondly, we are arguing that the agent orange was ingested via potable water system because the ship's evaporators sucked in contaminated water and enhanced dioxin. This caused throat, tounge and mouth cancer which is not recognized as a presumptive cancer by VA. Australian people who have done the study very cooperative.
